Diplomat Daniele Mancini was heading home on Tuesday afterthe supreme court in New Delhi delayed a decision on a hearing for MassimilianoLatorre and Salvatore Girone, who were part of a military security teamprotecting the 104,000-dwt Dolphin Tanker ship Enrica Lexie(built 2008), Reuters said.
They are accused of mistaking the fishermen for pirates offthe southern Indian state of Kerala.
The judge said India's government needed to produce morepaperwork on whether the trial could be heard under anti-piracy legislation.
"The delaying tactics by the Indian courts two yearsafter the incident is unacceptable and demonstrates India's desire toprocrastinate beyond all limits," Michele Valensise, the director generalof the foreign ministry, said in a statement.
The hearing is due to recommence on 24 February.
Latorre and Girone are staying at the embassy in Delhiduring the trial.
