A case being brought against Nobu Su and his associates by a company controlled by Polys Haji-Ioannou along with other claimants looks set to be heard in London’s High Court this autumn.

During a hearing Friday in front of Justice Andrew Smith it emerged that a trial date of 20 October had been set for the case to come to court in front of Judge Julian Flaux.

The case centres on a claim of around $46m that is being made against Su, who controls shipowning company Today Makes Tomorrow (TMT), and a number of associated companies relating to a series of forward freight agreements (FFAs).

The FFAs were contracted in mid 2008 between Su and Haji-Ioannou’s Lakatamia Shipping, a single ship company that owns the 48,700-dwt product tanker Lakatamia(built 2000).

Su, who was unrepresented in court Friday, objects to the case and has publicly attacked the Royal Bank of Scotland suggesting it contributed to $1bn of FFA losses which pushed TMT into Chapter 11 bankruptcy proceedings.

Lawyers for the claimants told Justice Smith Friday that they had sent material to Su on the advice of his former solicitors but had not had any response.

The judge gave a directive that if Su did not lodge court certificates and continued to fail to respond then Haji-Ioannou’s lawyers should seek a short hearing with Justice Flaux when the courts resume in early October to determine how to proceed.
